Terms of Service

These Terms of Service (“Terms”) are a binding agreement between you (and the organization you represent) and İnisiyatif Yazılım Bilgisayar Danışmanlik Hiz. Ltd. Şti. (“Zervanor”, “we”, “us”) governing your access to and use of the Zervanor website, dashboard, APIs, and platform (together, the “Service”). By creating an account or using the Service, you agree to these Terms, our Privacy Policy, and our Cookie Policy.

1. Eligibility and accounts

You must be at least 18 years old and able to form a binding contract. You are responsible for the accuracy of your registration details, for keeping your credentials secure, and for all activity under your account. Notify us promptly at info@zervanor.com of any unauthorized use.

2. The Service and beta status

Zervanor is an automation platform for building and running workflows and agents. During the invite-only beta, parts of the Service are provided free of charge, may change or be withdrawn, and may contain bugs or limitations. We provide the beta “as is” and may impose usage limits.

3. Acceptable use

You agree not to, and not to allow anyone to:

• use the Service for unlawful, infringing, harmful, or fraudulent purposes;
• send spam, malware, or content that violates third-party rights;
• attempt to gain unauthorized access to, disrupt, or overload the Service or other tenants;
• reverse engineer, resell, or circumvent usage limits except as permitted by law;
• use the Service to build automations that violate the terms of any connected third-party service; or
• process personal data through the Service unlawfully or without a proper legal basis.

We may suspend or terminate accounts that breach this section.

4. Your content and connected services

You retain all rights to the data, workflows, and content you create or process (“Customer Content”). You grant us a limited license to host and process Customer Content solely to provide the Service. You are responsible for obtaining any rights and consents needed to connect third-party services and to process the data flowing through your automations. Our processing of personal data within Customer Content is governed by the Data Processing Agreement.

5. Fees

The Service is not offered for sale. Zervanor charges no subscription or usage fees under these Terms, and there is no billing, payment, renewal or refund to speak of. Should that ever change, these Terms will be updated and notice given before any fee applies.

6. Intellectual property

The Service, including its software, design, and content (excluding Customer Content and third-party materials), is owned by Zervanor and its licensors and is protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service under these Terms. All rights not expressly granted are reserved.

7. Third-party services

The Service integrates with third-party providers (e.g. connectors and AI providers). Your use of those services is subject to their own terms, and we are not responsible for them.

8. Disclaimers

To the maximum extent permitted by law, the Service is provided “as is” and “as available”, without warranties of any kind, whether express or implied, including fitness for a particular purpose, accuracy, and non-infringement. We do not warrant that the Service will be uninterrupted or error-free.

9. Limitation of liability

To the maximum extent permitted by law, Zervanor will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenues, data, or goodwill. Our total liability arising out of or related to the Service will not exceed the greater of the amounts you paid us in the 12 months before the claim, or the equivalent of one hundred euros (€100). Nothing limits liability that cannot be limited by law.

10. Indemnity

You will indemnify and hold Zervanor harmless from claims arising out of your Customer Content, your use of the Service, or your breach of these Terms or applicable law.

11. Suspension and termination

You may stop using the Service and close your account at any time. We may suspend or terminate your access if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your right to use the Service ends; sections that by their nature should survive (e.g. IP, disclaimers, liability) will survive.

12. Changes to these Terms

We may update these Terms. We will post the updated version with a new “Last updated” date and, for material changes, provide reasonable notice. Continued use after changes take effect constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the Republic of Türkiye. The courts and enforcement offices of İstanbul (Anadolu) have jurisdiction, without prejudice to any mandatory consumer-protection rights you may have in your country of residence.
